TERMS AND CONDITIONS, QUALIFYING CRITERIA, AND ACKNOWLEDGEMENTS. In consideration for the Lease and possession of the Premises, Resident acknowledges and fully accepts the terms and agrees to the representations expressed in this Addendum as well as all rules, requirements, regulations, and consequences associated with the Promotion.
- Terms and Conditions. Resident fully acknowledges and agrees to the terms and conditions attached hereto as Exhibit A. The Terms and Conditions in Exhibit A are fully incorporated into this Addendum.
- Submission Deadline and Other Qualifying Criteria. In addition to the Terms and Conditions set forth in Exhibit A, the following qualifying criteria shall apply to the Promotion. In order to be eligible for participation in the Promotion, a resident must:
- submit a qualifying video in compliance with this Addendum and the Terms and Conditions on or before October 31, 2024 (the “Submission Deadline”);
- be a named leaseholder on a lease between the resident and the Owner;
- not be in default of the Lease as of the Submission Deadline;
- currently reside in the Premises as of Submission Date; and
- agree to the terms of this Addendum; and
- ensure that all likes associated with the submission come from legitimate, authentic profiles and must refrain from purchasing likes or engaging third-party services or bots to generate likes.
- Acknowledgments and Representations. Resident agrees, represents, and acknowledges that Resident has not received or relied upon any promises, guarantees, or other representations from Owner or Owner’s managing agents regarding the Promotion, any future promotions, or Resident’s probability of winning the Promotion or any future promotion. Resident acknowledges that they may not win the Promotion and that they may never win any other concession or promotion offered from time to time at the Community but have nevertheless freely elected to apply to live in the Community, signed the Lease, and taken possession of the Premises based upon the consideration contained elsewhere in the Lease. Resident further acknowledges and agrees that the winners for the Promotion are not determined by chance. Resident agrees to accept the outcome of the Promotion as final.
